Car accidents: 3 people injured in British Columbia

Three men are in the hospital following a rollover crash on the Malahat, according to local sources. Car accidents involving only one vehicle are common and often result in injury to driver and passenger/s alike, as appears to be the case here. Thankfully, British Columbia law allows passengers in such a situation the same legal recourse as they would have if another driver and vehicle were involved.

The accident took place around 9 a.m. the morning of Nov. 19. A northbound vehicle carrying three people apparently crossed the highway before rolling into a ditch and striking a concrete divider. Firefighters responding to the scene said it was astonishing the vehicle did not hit any other cars. All three occupants of the vehicle were taken to local hospitals.

Their conditions are currently unknown, but not believed to be life threatening. Police are still in the process of determining what caused the driver to lose control of the vehicle, but they have not yet charged the man with a crime. The investigation is ongoing as of this report, and the highway was closed for some two hours to facilitate crash reconstruction.

Single-vehicle car accidents are often the fault of driver error. If this is the case here, British Columbia authorities may yet charge the driver with a crime. Even if they do not, however, his passengers are entitled under provincial law to file personal injury lawsuits against him. These claims require material evidence of driver error in order for complainants to be entitled to damages.
